BackgroundIn specific situations it may be necessary to make an exception to the general rule of informed consent for scientific research with an intervention. Earlier reviews only described subsets of arguments for exceptions to waive consent.MethodsHere, we provide a more extensive literature review of possible exceptions to the rule of informed consent and the accompanying arguments based on literature from 1997 onwards, using both Pubmed and PsycINFO in our search strategy.ResultsWe identified three main categories of arguments for the acceptability of (...) a consent waiver: data validity and quality, major practical problems, and distress or confusion of participants. Approval by a medical ethical review board always needs to be obtained. Further, we provide examples of specific conditions under which consent waiving might be allowed, such as additional privacy protection measures.ConclusionsThe reasons legitimized by the authors of the papers in this overview can be used by researchers to form their own opinion about requesting an exception to the rule of informed consent for their own study. Importantly, rules and guidelines applicable in their country, institute and research field should be followed. Moreover, researchers should also take the conditions under which they feel an exception is legitimized under consideration. After discussions with relevant stakeholders, a formal request should be sent to an IRB. (shrink)

Arnaldo Momigliano considered Robertson to be less successful than Edward Gibbon in his integration of the three elements of eighteenth-century historical writing, philosophy, narrative, and erudition. 2 Despite Robertson's stated belief that "arrangement" was the principal task of the historian, his organizational framework appeared to foster separation rather than integration. 3 Thus, his central work, The History of the Reign of Charles V (1769), is divided into three discrete parts. An apparently conventional narrative of high politics and diplomacy is prefaced by an essay on medieval Europe, A View of the Progress of Society in Europe, which was regarded by his contemporaries as a classic of "philosophical" history, 4 while [End Page 261] Robertson appended to both copious "Proofs and Illustrations." The structure of The History of America (1777) is even less integrated, despite criticalpraise of its "regular plan... complete narration and perfect whole." 5 To other critics his interpolation of dissertations upon the "condition and character" of the Americans, Mexicans, and Peruvians, seemed to sever the thread of the narrative and consequently to break up the unity of the work. 6 Yet as this paper will seek to demonstrate, there was a vital connection between the narrative and "philosophical" components of Robertson's major histories: the theoretical dissertations served recognizably narrative purposes. The bridge between them lies in the complex notion of character created by the expansion of historical forms in the eighteenth century."Philosophical" history defined itself in opposition to the vacuities and muddles of conventional political-diplomatic historical narrative. Its advantages over narrative were various: the revelation of general rather than particular causes, grounding the history on more certain and less random principles: 7 the penetration of causes "insensible" and invisible to the eyes of a careless observer, obscured by the "great theatre of the world"; 8 a broadening of the subject-matter, away from the mere rehearsal of the struggles between crown and nobility or fixation with constitution and government, towards a more inclusive and heterogeneous history of "manners, including arts, sciences, society" and what today would be termed "mentalities," and, related to the last point, a principle of organization that would reduce the apparent chaos and multiplicity of the past to a simple and luminous plan of arrangement. 9 This was the most exacting requirement for the philosophical historian. As a critic wrote of Robertson's View, its value lay most in its "vast and magnificent plan... that profound and easy art of classing [facts], in such a manner that... the accumulated multiplicity of events is gradually reduced to a small number." This paper addresses the question of how Robertson's History of America depicts the transition of world history from pre-modern disorder to a recognisably modern commercial order. It argues that in his narrative of action he moves beyond the limitations imposed by stadial forms of history, with which America is usually associated, and displays the importance of disordered forms of activity as a creative force in shaping the modern world. It concludes by suggesting that a close reading of his history does (...) not support Robertson's assumptions concerning the formation of a stable, ordered and industrious ‘commercial character’ out of this process, but rather establishes a more complex and less teleological path to modernity. ☆ This paper was presented in abbreviated form at the conference on ‘Political Economy and 18th Century Scottish Culture’ at George Mason University, June 2001. Rhodopsin, upon activation by light, transduces the photon signal by activation of the G‐protein, transducin. The well‐studied rhodopsin/transducin system serves as a model for the understanding of signal transduction by the large class of G‐protein‐coupled receptors. The interactive form of rhodopsin, R*, is conformationally similar or identical to rhodopsin's photolysis intermediate Metarhodopsin II (MII). Formation of MII requires deprotonation of rhodopsin's protonated Schiff base which appears to facilitate some opening of the rhodopsin structure. This allows a change in conformation at (...) rhodopsin's cytoplasmic surface that provides binding sites for transducin. Rhodopsin's 2nd, 3rd and putative 4th cytoplasmic loops bind transducin at sites including transducin's 5 kDa carboxyl‐terminal region. Site‐specific mutagenesis of rhodopsin is being used to distinguish sites on rhodopsin's surface that are important in binding transducin from those that function in activating transducin. These observations are consistent with and extend studies on the action of other G‐protein‐coupled receptors and their interactions with their respective G proteins. (shrink)

Researchers from diverse disciplines, including organismal and cellular physiology, sports science, human nutrition, evolution and ecology, have sought to understand the causes and consequences of the surprising variation in metabolic rate found among and within individual animals of the same species. Research in this area has been hampered by differences in approach, terminology and methodology, and the context in which measurements are made. Recent advances provide important opportunities to identify and address the key questions in the field. By bringing together (...) researchers from different areas of biology and biomedicine, we describe and evaluate these developments and the insights they could yield, highlighting the need for more standardisation across disciplines. We conclude with a list of important questions that can now be addressed by developing a common conceptual and methodological toolkit for studies on metabolic variation in animals. (shrink)

We examined participants' reading and recall of informed consent documents presented via paper or computer. Within each presentation medium, we presented the document as a continuous or paginated document to simulate common computer and paper presentation formats. Participants took slightly longer to read paginated and computer informed consent documents and recalled slightly more information from the paginated documents. We concluded that obtaining informed consent online is not substantially different than obtaining it via paper presentation. This paper presents an oral history of farming in the Southern Yangtze Valley in China, covering the period from pre-liberation to recent market liberalization. Using the stories and observations of 31 elderly residents of a small water town, the paper describes the hard labor of traditional farming practices and the acquiescence of many when, post-liberation, they could leave farming for better-paid factory work. However, in a departure from conventional analyses, these oral histories suggest that the co-dependency culture of traditional farming (...) has broken down, and farmers are unwilling to return to the land and continue farming. The changes in knowledge cultures of local farmers in recent decades are not likely to lead to pathways to working with incoming modern “outsider farmers,” nor able to be blended with potential new “urbanite” knowledges of those who might wish to increase organic farming. The current knowledge cultures of these farmers has shifted as needed to the optimization of family unit needs, naturally leading them to urbanization and the relinquishing of their ties to the land. For cultural rather than economic reasons, these farmers see themselves as the last peasant farmers of Tianshanzhuang. (shrink)

The Patient Self-Determination Act (PSDA) requires hospitals to ask patients upon admission whether they have an advance directive. Although the PSDA has received extensive criticism, little attention has been paid to the cost of the law, either during its legislative course or following its implementation. Nonetheless, several tangible and intangible costs are associated with the PSDA. Such costs may be incurred by different parties. This paper examines the costs and benefits of the PSDA and illustrates the extent of some of (...) its tangible costs. The incremental start-up cost for one institution's response to the PSDA is estimated to be $49,304 ($1.31 per admission) and the total implementation cost of the program to be $114,528. In addition, the national incremental start-up cost for hospitals to implement the PSDA is estimated to be between $43,625,114 and $101,569,922. Finally, the potential implications of the PSDA for future governmental health care ethics regulation are discussed. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:The Theologian's Doubts:Natural Philosophy and the Skeptical Games of GhazālīLeor HaleviIn the history of skeptical thought, which normally leaps from the Pyrrhonists to the rediscovery of Sextus Empiricus in the sixteenth century, Abū Ḥāmid Muḥammad al-Ghazālī (1058-1111) figures as a medieval curiosity. Skeptical enough to merit passing acknowledgment, he has proven too baffling to be treated fully alongside pagan, atheist, or materialist philosophers. As a theologian defending certain Muslim (...) dogmas, Ghazālī has not met what historians consider the mark of the true skeptic, a mind doubting the possibility of all systems of knowledge. But what is fascinating about him is that he brought into practical operation the tools of what I call "functional skepticism."1He denied the claims to truth of Aristotelian physics—whose basis he showed to rest on groundless belief—then turned and argued for the possibility of the Resurrection tooth and nail. The scholarly debate on The Incoherence of the Philosophers (Tahāfut al-falāsifa) has concentrated on the extent to which Ghazālī qua Ashcarite theologian was seduced into Aristotelian philosophy despite himself.2 In my view this debate has been misguided in the attempt to distill the [End Page 19] essence of Ghazālī from the book's eclectic theology; I will argue for a different view of Ghazālī on the basis of a close reading of key passages. In the unusual sections where Ghazālī applies Aristotelian language to a world not following the ordinary laws of physics, some have found Ghazālī slipping, unconsciously perhaps, into an Aristotelian frame of mind. I will show that, as a skeptical theologian with a dialogic imagination, he was rather deconstructing Aristotelian discourse while playing a Wittgensteinian sort of language game.Natural Philosopher or Speculative Theologian?The disagreement about the extent to which philosophy infected Ghazālī is ancient. Ghazālī might have studied philosophy only in order to refute it. He himself defended his philosophizing with the claim that one cannot deconstruct a system of thought until one has understood it so deeply as to elaborate upon its fundamental principles.3 His Maqāṣid al-falāsifa was in fact received, especially in trans-Pyrenean Europe, as a philosopher's genuine summary of the object of philosophy.4 The book strikes me as suspiciously creative in its representation of philosophical discourse, but it appears in any case as an expert and surprisingly unbiased treatment.5 Arabic readers knew that Ghazālī had also written a polemical treatise against philosophy, Tahāfut al-falāsifa, but they still wondered about his engagement with the ideas he challenged. Abū Bakr Ibn al-cArabī, for example, commented that Ghazālī had been unable to extricate himself from philosophy.6 Other philosophers pondered whether or not he had been a closeted member of their charmed circle and sought in his writings traces of esoteric philosophy.7Averroës's own sober sense of distance between philosophy and theology was partially a reaction to what he perceived as Ghazālī's dangerous and carefree mixture of the two sciences.8 He attacked Ghazālī's book in The Incoherence [End Page 20] of the Incoherence to restore philosophy's sense of purity, an aim he sought to accomplish by separating religious concerns from the philosopher's field of inquiry.9 Ironically, such a separation is precisely what Ghazālī might have wished to provoke by crisscrossing and blurring the line between religion and philosophy.The modern debate on chapter 17 of Tahāfut al-falāsifa has concentrated on defining Ghazālī as either a natural philosopher or an occasionalist theologian. This paper concludes a special feature of Sustainability Science that explores a broad range of social value theoretical traditions, such as religious studies, social psychology, indigenous knowledge, economics, sociology, and philosophy. We introduce a novel transdisciplinary conceptual framework that revolves around concepts of 'lenses' and 'tensions' to help navigate value diversity. First, we consider the notion of lenses: perspectives on value and valuation along diverse dimensions that describe what values focus on, how their sociality is envisioned, and what epistemic and (...) procedural assumptions are made. We characterise fourteen of such dimensions. This provides a foundation for exploration of seven areas of tension, between: (1) the values of individuals vs collectives; (2) values as discrete and held vs embedded and constructed; (3) value as static or changeable; (4) valuation as descriptive vs normative and transformative; (5) social vs relational values; (6) different rationalities and their relation to value integration; (7) degrees of acknowledgment of the role of power in navigating value conflicts. In doing so, we embrace the 'mess' of diversity, yet also provide a framework to organise this mess and support and encourage active transdisciplinary collaboration. We identify key research areas where such collaborations can be harnessed for sustainability transformation. Here it is crucial to understand how certain social value lenses are privileged over others and build capacity in decision-making for understanding and drawing on multiple value, epistemic and procedural lenses. Through the ability to preview the future , people can anticipate how best to think, feel and act in just about any setting. But exactly what factors determine the contents of prospection? Extending research on action identification and temporal construal, here we explored how action goals and temporal distance modulate the characteristics of future previews. Participants were required to imagine travelling to Egypt to climb or photograph a pyramid. Afterwards, to probe the contents of prospection, participants provided a sketch of (...) their imaginary experience. Results elucidated the impact of goal type and temporal distance on mental imagery. While a climbing goal prompted participants to draw a larger pyramid in the near than distant future, a photographic goal influenced only the compositional complexity of the sketches. These findings reveal how action goals and temporal distance shape the contents of future simulations. (shrink)

1 Evidence-based policy requires researchers to provide the answers to ecological questions that are of interest to policy makers. To find out what those questions are in the UK, representatives from 28 organizations involved in policy, together with scientists from 10 academic institutions, were asked to generate a list of questions from their organizations. 2 During a 2-day workshop the initial list of 1003 questions generated from consulting at least 654 policy makers and academics was used as a basis for (...) generating a short list of 100 questions of significant policy relevance. Short-listing was decided on the basis of the preferences of the representatives from the policy-led organizations. 3 The areas covered included most major issues of environmental concern in the UK, including agriculture, marine fisheries, climate change, ecosystem function and land management. 4 The most striking outcome was the preference for general questions rather than narrow ones. The reason is that policy is driven by broad issues rather than specific ones. In contrast, scientists are frequently best equipped to answer specific questions. This means that it may be necessary to extract the underpinning specific question before researchers can proceed. 5 Synthesis and applications. Greater communication between policy makers and scientists is required in order to ensure that applied ecologists are dealing with issues in a way that can feed into policy. We prove that the set of properties describable by a uniform sequence of first-order sentences using at most k + 1 distinct variables is exactly equal to the set of properties checkable by a Turing machine in DSPACE[n k ] (where n is the size of the universe). This set is also equal to the set of properties describable using an iterative definition for a finite set of relations of arity k. This is a refinement of the theorem PSPACE = (...) VAR[O[1]] [8]. This unrestricted generalization (◊K), as is now well known, falls prey to Fitch’s Paradox (Fitch 1963: 38, Theorem 1). It can be used as the only suspect principle, alongside others that cannot be impugned, to prove quite generally, and constructively, that the set {p, ¬Kp} is inconsistent (Tennant 1997: 261). From this it would follow, intuitionistically, that any proposition that is never actually known to be true (by anyone, (...) at any time) is false; and it would follow, classically, that every truth is known (by someone, at some time). It became customary in the eighteenth century to praise Longinus in ways that mimicked one of his own favorite turns of thought—to identify enthusiastically two elements that would more commonly be thought of as quite distinct. To say, with Boileau and Pope, that Longinus “is himself the great Sublime he draws,” or to profess to doubt, as Gibbon did, “which is the most sublime, Homer’s Battle of the Gods or Longinus’ apostrophe…upon it,” is knowingly to override certain conventional lines of (...) demarcation—between writers and their subject matter, between text and interpretation—very much in the manner of Longinus overriding the distinction between Homer and his heroes, between sublime language and its author , or between sublime poet and his audience .1 Longinus’ admirers, struck by the force of the treatise, are usually willing to release him from the strictures of theoretical discourse and allow him the license of a poet; they are likely to appreciate his transgressions of conventional limits without ever calling them into question. It has been left to more skeptical readers, wary of Longinus’ “transports,” to draw attention to his odd movements of thought: W. K. Wimsatt, for example, is unsympathetic but acute when he accuses Longinus of “sliding” from one theoretical distinction to another, a slide “which seems to harbor a certain duplicity and invalidity.”2 Wimsatt is right: something one might want to call a “slide” is observable again and again in the treatise, and not merely from one theoretical distinction to another. One finds in the treatise a rhetorician’s argument conducted with great intelligence and energy, but one also discovers that it is remarkably easy to lose one’s way, to forget which rhetorical topic is under consideration at a particular point, to find oneself attending to a quotation, a fragment of analysis, a metaphor—some interestingly resonant bit of language that draws one into quite another system of relationships. I want to attempt to follow that movement here, to hold it in mind and to question its implications. AGM-theory, named after its founders Carlos Alchourrón, Peter Gärdenfors and David Makinson, is the leading contemporary paradigm in the theory of belief-revision. The theory is reformulated here so as to deal with the central relational notions 'J is a contraction of K with respect to A' and 'J is a revision of K with respect to A'. The new theory is based on a principal-case analysis of the domains of definition of the three main kinds of theory-change (expansion, contraction and (...) revision). The new theory is stated by means of introduction and elimination rules for the relational notions. In this new setting one can re-examine the relationship between contraction and revision, using the appropriate versions of the so-called Levi and Harper identities. Among the positive results are the following. One can derive the extensionality of contraction and revision, rather than merely postulating it. Moreover, one can demonstrate the existence of revision-functions satisfying a principle of monotonicity. The full set of AGM-postulates for revision-functions allow for completely bizarre revisions. This motivates a Principle of Minimal Bloating, which needs to be stated as a separate postulate for revision. Moreover, contractions obtained in the usual way from the bizarre revisions, by using the Harper identity, satisfy Recovery. This provides a new reason (in addition to several others already adduced in the literature) for thinking that the contraction postulate of Recovery fails to capture the Principle of Minimal Mutilation. So the search is still on for a proper explication of the notion of minimal mutilation, to do service in both the theory of contraction and the theory of revision. The new relational formulation of AGM-theory, based on principal-case analysis, shares with the original, functional form of AGM-theory the idealizing assumption that the belief-sets of rational agents are to be modelled as consistent, logically closed sets of sentences. The upshot of the results presented here is that the new relational theory does a better job of making important matters clear than does the original functional theory. A new setting has been provided within which one can profitably address two pressing questions for A GM-theory: (1) how is the notion of minimal mutilation (by both contractions and revisions) best analyzed? and (2) how is one to rule out unnecessary bloating by revisions? Colours are not the sorts of thing that are amendable to traditional forms of scientific explanation. To think otherwise is to mistake their ontology and ignore their normativity. The acquisition and use of colour categories is constrained by the logic of colour grammars.

We look for a converse to a result from [N. Thapen, A model-theoretic characterization of the weak pigeonhole principle, Annals of Pure and Applied Logic 118 175–195] that if the weak pigeonhole principle fails in a model K of bounded arithmetic, then there is an end-extension of K interpretable inside K. We show that if a model J of an induction-free theory of arithmetic is interpretable inside K, then either J is isomorphic to an initial segment of K , or (...) K is isomorphic to an initial segment of J and in this case the weak pigeonhole principle fails in K. This result is formulated in terms of a theory of bounded arithmetic with a greatest element. We go on to consider structures defined by oracles, and use the probabilistic witnessing theorem for to give a general criterion for what can be proved about these using the weak pigeonhole principle. We also show that the injective WPHP is not provable in this theory in the relativized case. (shrink)

Values-based medicine derives from an approach first introduced into the philosophy of psychiatry, which aims to demonstrate that the reality of mental illness is not inconsistent with the scientific status of medicine. Associated primarily with the work of K.W.M. Fulford, the argument is that practitioners need to be ethical anti-descriptivists if they are to avoid the authoritarianism of evidence-based medicine, which overlooks the fact that genuine value conflicts can arise during all clinical encounters, and that psychiatry is just the most (...) explicit area in which these occur. This paper takes a philosophically therapeutic line and argues that, by reducing values to the status of preferences, antidescriptivism undermines the value of 'value' and leaves the practitioner with a reduced ability to discern and negotiate genuine conflicts of value. The conclusion is that patients should be respected, not as instantiations of preferences but as valuers ; and that this requires practitioners to become more cosmopolitan and sympathetic, not more theoretically sophisticated. We give a new characterization of the strict $$\forall {\Sigma^b_j}$$ sentences provable using $${\Sigma^b_k}$$ induction, for 1 ≤ j ≤ k. As a small application we show that, in a certain sense, Buss’s witnessing theorem for strict $${\Sigma^b_k}$$ formulas already holds over the relatively weak theory PV. We exhibit a combinatorial principle with the property that a lower bound for it in constant-depth Frege would imply that the narrow CNFs with short depth j Frege refutations form a strict hierarchy with (...) j, and hence that the relativized bounded arithmetic hierarchy can be separated by a family of $$\forall {\Sigma^b_1}$$ sentences.
